Dear Prospective Small Cell Technology Franchisee,
Thank you for your interest in working with the City of New Orleans on our efforts to optimize service and accessibility by proposing a small cell system. The Council Utilities, Cable, Technology, and Telecommunications Committee ("UCTTC") has set a goal and made it a priority to move forward with ushering in small cell technology without delay.
As small cell technology is relatively new to our City, the UCTTC and Council Utilities Regulatory Office ("CURO") continue to work with the several departments and entities under the City of New Orleans umbrella to ensure an efficient process and symbiotic relationship among all parties.
Due to the newness of this technology and the unique implications it will have on our existing infrastructure, I want each small cell franchise applicant to understand the special circumstances that will apply to these applications. All small cell franchise agreements will include the following unique language:
Grantee acknowledges and agrees that small cell wireless systems present unique issues related to matters of aesthetics, pole proliferation, facilities location, unit stacking, visual clutter, duplication of infrastructure, etc. that are not presented by wireline systems that are largely installed underground.
Grantee therefore acknowledges and agrees that this franchise is subject to the following provisos:
- That no construction of any above-ground facilities may commence until Grantee meets with Grantor to discuss the actual physical characteristics of any such facilities including, but not limited to, new poles, radio or transmission units, attachments, nodes, etc.
- That no construction of any above-ground facilities may commence until Grantee meets with Grantor to discuss coordination of the location of all above-ground facilities with other small cell system grantees and any pending applicants for new or additional small cell systems.
- That Grantee agrees to cooperate with Grantor to mitigate the issues related to matters of aesthetics, including, but not limited to, pole proliferation, facilities location, unit stacking, visual clutter and duplication of infrastructure. Grantee further acknowledges that Grantor intends to obtain technical assistance in dealing with these matters and that Grantee agrees to cooperate with Grantor in incorporating such technical assistance into the franchise as appropriate.
- Grantor acknowledges that failure to comply with these provisos could result in Grantor suspending or terminating the franchise.
As Chair of the UCTTC, I believe that this language expresses the appropriate spirit of cooperation that will allow us to achieve the maximum benefits from this new technology with the least amount of adverse impacts for our residents. Your agreement to work in consonance with these guiding principles along with all the entities involves is important as it will serve to assist this process in moving forward in an efficient manner. Your cooperation is very much appreciated.
